Lease and release
Description: Theophilus Shelton of Heath, Yorks., gent., and Richard Wilson, rector of Babworth, Notts, clerk, of the first part; Richard Witton of Wakefield, Yorks., esq., and John Spencer of Cannon Hall, par. Cawthorne, gent., of the second part; Nicholas Burley of Woolley, Yorks., gent., of the third part. Reciting (i) the will of Godfrey Copley, which made Witton and Spencer trustees to pay his debts (ii) Bill in Chancery against Witton and Spencer, by Copley's creditors, for the sale of premises, and settlement of debts; (iii) Chancery decree of 22 Dec 1702 by which lands were to be sold to the best purchasor (iv) a report of 6 Dec 1703 stating that Shelton and Wilson were the best purchasors, offering £2,500 and that, therefore the lands should be conveyed to them. (v) that, before the report was confirmed, Nicholas Burley offered £2,600 (vi) report of 11 Jan 1706 which overturned the first report. By this indenture, Shelton and Wilson, in return for £2,500 paid them by Burley, and Witton and Spencer, in return for £100 paid by Burley, release the above recited lands to Burley.
