Marriage Settlement

Description: 1. John Spencer, Cannon Hall, Cawthorne, gent.; William Spencer, his son; 2. Benjamin Ashton, Hathersedge, co. Derbys., esq.; Christian Ashton, Spinster, daughter of Benjamin; to 3. Benjamin Ashton, Hathersedge, Derby, gent., second son of Benjamin Ashton senior; and Nicholas Burley, par. Wooley, gent.; 4. Theophilus Shelton, Darrington, esq., and Charles Bagshaw, Bakewell, co. Derby., gent. (trustees). In consideration of a marriage between William Spencer and Christian Ashton; The manor farm or capital messuage called Cannon Hall, Cawthorne, with all closes (named), all of yearly value of £100; also the messuage or tenement in Cawthorne with parcels of land belonging, in the West field of Cawthorne, now in tenure of Thomas Armfield, at or under yearly rent of £41 6s. 8d. Also the messuage or tenement in Cawthorne commonly called the Kettleroyds, with the several closes now in the occupation of Jonas Newton, at or under yearly rent of £9 5s. Also the messuage with appurtenances in Cawthorne, with several closes now in the tenure of John Thackeray, at or under yearly rent of £7 11s. 6d. Also the messuage in Cawthorne with the parcels of land called the Croft, the Pingle, the Cliff hill Ings, and Kent royd Ing, in tenure of John Taylor, at yearly rent of £5 5s. 4d. Also the messuage with the orchard and croft belonging, in Cawthorne, in tenure of Mathew White, at yearly rent of £3 10s. Also all one piece of land, c. ½ acre in the West field of Cawthorne in possession of John Fretwell at yearly rent of 6s. Also two closes of land in Cawthorne called by several names of Great Gill Royd and the Upper most Gill Royd, of yearly value of £6 13s. 4d. Also the messuage with the closes in Cawthorne, now in tenure of Timothy Fawley, at yearly rent of £21. Also, the closes of land in Cawthorn called the New Close Bottom, the Dry Croft, and one parcel of land adjoining the Dry crofts, now in tenure of Thomas Cockshutt, clerk, at yearly rent of £7. Also the messuage called Hollinghouse in Clayton, par. High Hoyland and the several closes of land belonging, now in the tenure of Thomas Fawley, at the yearly rent of £32. Also the one close or parcel of land in Cawthorne, called the Nooks; also the Watercorn Mill called Okenthorp als Jowett House Miln with the kiln, tithes etc., due upon the four closes called the Milnefields, now in tenure of William Spencer, at yearly rent of £19 10s. Also the moiety of the manor of Barnby, par. Cawthorne, and captial messuage called Barnby Hall, with the closes etc. belonging in the tenure of Edward Smithson, Timothy Bever, Francis Turton, Richard Field, John Clegg, Edward Barber, William Thorp, George Dixon, John Bolton, and John Roebuck, at yearly rent of £108 7s. 5d; also the moiety of all tithes, now in occupation of Timothy Fawley of yearly value of 20s. Also the moiety of the furnace called Barnby Furnace with the closes called the New Dam and New Dam Close, and of the woods called Great Hugsetts, all in Cawthorne, and residue in Silkstone; value of woods is £22 yearly. Also all tithes, rents etc. To John Spencer and heirs until the marriage of William Spencer and Christian Ashton, and then, (concerning the lands and messuages of Timothy Fawley, Thomas Cockshutt and Thomas Fawley, and the moiety of the furnace, and closes called New Dam, New Dam Close, and of Hugsetts wood) to specified uses; and concerning the other lands and premises, to use of William Spencer for term of 99 years or his life, and then to specified uses, to permit William Spencer to receive the rents and issues. After the death of W. Spencer, concerning the lands, premises etc. in possession of Thomas Armfield, Jonas Newton, John Thackeray, John Taylor, Mathew White, William Spencer, John Fretwell, the closes called Gillroyds and moiety of manor of Barnby, and of Barnby Hall to the use of Christian Ashton for her life and in lieu of dower; and, concerning Cannon Hall, and all other premises etc., in possession of John Spencer, after death of William Spencer and all the lands etc. limited to Christian Spencer, after her death, to go to use of Theophilus Shelton and Charles Bagshaw for term of 500 years upon trust, after end of the estate, to specified uses. Upon further trust that Theomphilus Shelton and Charles Bagshaw pay the portions to any daughters provided that if heir at law in remainder after 500 years pays to the satisfaction of Shelton and Bagshaw, theirs heirs, the sums mentioned, and that the heirs shall attend the inheritance. Provided also that William Spencer, and Edward Spencer may lease the premises for term of 21 years; and provided Edward Spencer may appoint or assign trusts to any woman he may marry; and also the recited premises to remain free of all encumbrances, deeds, and mortgages etc. made by John Spencer.
