Description: Folio 362. To: The General Board of Health. From: George Bailey, Clerk to the Luton Local Board, Luton [Bedfordshire]. Subject Matter: Letter referring to an ancient sewer, probably 100 years old, which takes the sewage of 8 or 9 houses into the River Lea, and where the this sewer is to be connected to the main sewer and to intercept the sewage from the river, which the Board are obliged to do under certain Chancery proceedings some time instituted against them. Bailey explains that if they intercept the sewer it will be necessary to enter private land, but the medical officer's opinion is that it is not a nuisance in itself as the sewage running from it would have a small affect on the stream, and that the intercepting of it would be considered an additional expense, but although it would be necessary to bring it through the town and pleasure grounds, it would be of great value. He therefore asks whether the expense of directing the sewer and the compensation of this would be recovered under the Nuisances Removal Act or the Public Health Act 1848 from the parties using the sewer.
