Description: Folios 127-128. To: The General Board of Health. From: George Bailey, Clerk to the Luton Local Board, Luton [Bedfordshire]. Subject Matter: Letter referring to a letter of the 23 October 1852, respecting a person possessing certain gardens in a private road and liable for the expenses of sewering etc. Bailey explains that since then the sewering has been completed in accordance with section 69 of the [Public Health] Act 1848, and the expenses settled by the surveyor, but the proprietors of the gardens refuse to pay, alleging that the Board has no power to make the demand as the land and the gardens are not benefitting from the sewer. He states that Luton is rapidly improving and much land is being sold around these gardens for development. He gives an explanation of the legal issues that are likely to arise from this, and asks for advice on this matter.
